Terms of service

These Terms apply to the HR and attendance management service provided by Checking (the “Service Operator”) GI-JUN 기준(the “Service”) and set forth the terms and procedures for use, and the rights, obligations, and responsibilities of the Service Operator and members.

1. “Service” means all HR management features provided by the Service Operator through https://www.gijun.co.kr and the mobile app, including attendance, leave, expense reports, e-contracts, onboarding, and notices.
2. “Customer company” means a corporation or sole proprietor that registers a company with the Service, invites its employees, and uses the Service.
3. “Administrator” means a member who performs company settings, employee management, and permission grants on behalf of a customer company.
4. “Member” means an administrator or employee who agrees to these Terms, creates an account, and uses the Service.
5. “Customer data” means all information entered or uploaded to the Service by customer companies and members, including employee information, attendance and leave records, documents, and attachments.

1. These Terms take effect when posted on the service screen or notified to Members by other means.
2. The service operator may change these Terms to the extent that such changes do not violate applicable laws. When changes are made, the service operator will specify the effective date and reason for the change and notify Members by in-service notice or email at least 7 days before the effective date (30 days before for changes unfavorable to Members).
3. If a Member does not indicate refusal by the effective date of the changed Terms and continues to use the service, the Member will be deemed to have agreed to the changes. Members who do not agree may terminate the service agreement.

1. An administrator applies for sign-up by entering company information and their own information and agreeing to these Terms and the collection and use of personal information. The service agreement is formed when the service operator accepts the application.
2. Employees create accounts through an administrator's invitation (invitation link). Invitation links have an expiration period and will be invalidated if incorrect passwords are entered repeatedly.
3. Members must be at least 14 years old and must not use another person's information without authorization or provide false information.
4. Members must securely manage their account information (email, password, and two-factor authentication methods) and immediately notify the service operator if they become aware of unauthorized use of their account. The service operator is not liable for damages caused by a Member's failure to manage their account properly.
5. A Member may belong to multiple customer companies, and permissions for each customer company are granted and revoked by the administrator of that customer company.

1. In principle, the service is provided 24 hours a day, year-round. However, all or part of the service may be temporarily suspended when necessary for operational or technical reasons, such as system maintenance, server expansion or replacement, or communication failures, and scheduled maintenance will be announced in advance.
2. The service operator may change or improve the content, features, or screens of the service. Changes that have a material impact on Members will be announced in advance.
3. Values automatically calculated by the service, such as leave days, overtime hours, and allowances, are reference values based on the rules set by the customer company and the input data. The customer company is responsible for final confirmation and legal judgment.
4. The service operator may terminate the service for unavoidable reasons, such as discontinuation of the business. In this case, the service operator will provide 30 days' prior notice and an agreed period during which the customer company can export its data.

1. The service is currently provided free of charge.
2. If the service operator introduces a paid plan or changes fees, it will announce the pricing structure, scope of application, and payment method 30 days before the effective date. A customer company that does not agree to conversion to a paid plan may export existing data and terminate the service agreement.

Members must not engage in the following acts.

1. Collecting, accessing, or using another person's account or personal information without authorization
2. Accessing or disclosing sensitive information such as employees' payroll, accounts, or addresses without legitimate authority from the customer company
3. Interfering with the normal operation of the service (automated bulk requests, exploiting vulnerabilities, reverse engineering, etc.)
4. Entering false attendance, leave, or expense records, or forging e-signatures
5. Acts that violate laws or these Terms

Administrators are responsible for securing a lawful basis under applicable laws (such as the Personal Information Protection Act and the Labor Standards Act) for entering and processing the personal information of their employees in the Service, and for providing the required notices to employees.

1. The service operator may access customer company screens and data to the minimum extent necessary to handle customer company support requests, investigate failures, and conduct security inspections. Such access is limited to read-only access, and the accessor, time, and target are recorded and provided upon the customer company's request.
2. Rights to customer data belong to the customer company. The service operator processes customer data only to the extent necessary to provide the service, respond to failures, maintain security, and comply with laws.
3. With respect to employee personal information, the customer company is the personal information controller, and the service operator is a processor entrusted to process the customer company’s work. Details are governed by Privacy policyapply.
4. The service operator takes reasonable safeguards, such as encrypting and storing sensitive items including payroll, account, and address information, and limiting access permissions to personnel designated by the customer company administrator.
5. Customer companies may view, edit, and export (CSV, etc.) customer data at any time through administrator features.
6. The service operator may use statistical information processed so that individuals cannot be identified to improve the service. Content entered into AI assistance features is provided to external AI providers only for the purpose of generating results for those features, and is configured not to be used for model training.

1. Intellectual property rights to software, designs, trademarks, documents, and other materials related to the service belong to the service operator.
2. Members may not copy, distribute, modify, create derivative works of, or commercially use the service without the service operator's prior consent.
3. Rights to customer data entered into the service by Members belong to the Member or the customer company.

1. If a Member violates the obligations in Article 7 or threatens the stable operation of the service, the service operator may restrict use or suspend the account after prior notice (or after-the-fact notice in urgent cases).
2. The service operator provides members with an opportunity to explain any use restrictions, and if the explanation is deemed valid, use will be resumed immediately.

1. Members may terminate the service agreement at any time using the account deletion feature on the profile screen. If any active affiliation remains, the customer company must first process the resignation, and if the member is the sole administrator, they may request company deletion.
2. When a customer company administrator requests company deletion from the company information screen, that customer company’s data will be permanently deleted after a 30-day grace period from the request date. During the grace period, the administrator may cancel the request, and the customer company is responsible for exporting and retaining any HR records that must be preserved by law before deletion.
3. Accounts of employees whose resignation has been processed by a customer company will be blocked from accessing that customer company’s service, and HR records such as attendance and leave will be retained until the customer company deletes them in accordance with its legal preservation obligations.
4. When the service agreement ends due to expiration, termination, or suspension of use, the customer company’s data will be retained for 90 days from the end date. If the contract is extended or use is resumed during this period, the data will be restored as-is, and the service operator will notify the administrator on the 60th and 83rd days after termination of the scheduled deletion and how to export data. After 90 days, the data will be permanently deleted, and the customer company is responsible for retaining HR records before then using the data export feature on the company information screen.

1. The service operator is exempt from liability if it cannot provide the service due to reasons beyond its reasonable control, such as natural disasters, war, failures of telecommunications carriers, or failures of cloud infrastructure providers.
2. The service operator is not responsible for the accuracy or legality of data entered by members, or for disputes between members or between a customer company and its employees.
3. Unless there is intentional misconduct or gross negligence by the service operator, the service operator’s liability for damages is limited to the total usage fees actually paid by the customer company to the service operator during the 12 months immediately preceding the occurrence of the damages. For damages arising during free use, the service operator is liable only in cases of intentional misconduct or gross negligence.

1. The service operator and members will consult in good faith to amicably resolve disputes arising in connection with use of the service.
2. If no agreement is reached, the laws of the Republic of Korea will govern, and a lawsuit will be filed in the court with jurisdiction under the Civil Procedure Act.
